Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you ("you") and TinyDesk.run ("we", "us"). By using the website, creating an account or buying credits, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the service.

2. What the Service Does

TinyDesk.run is an independent fan and parody tool. You upload a photo of a person, and an AI model puts that face into a fixed, roughly 19-second vertical video styled after the viral "Outstanding" Tiny Desk clip. You may add more photos for the saxophone player or the other band members; every seat you do not add is AI-generated.

• Not affiliated — We are not affiliated with, endorsed by or sponsored by NPR, NPR Music's Tiny Desk, Charlie Wilson or The Gap Band. "Tiny Desk" is a trademark of NPR.
• AI results vary — The video is generated by AI. The likeness is close but not exact, and two runs with the same photo can differ. We do not guarantee a particular look.
• Changes — We may change or improve the service, with reasonable notice where feasible.

3. Accounts and Eligibility

• Age — You must be at least 18 years old, or the age of majority where you live, to use the service. Do not upload photos of children.
• Sign-in — You sign in with your Google account, or with an email address and password, and are responsible for activity under your account.
• One account per person — Creating multiple accounts to abuse credits or limits is not allowed.

4. Credits and Payments

• Credit packs — Credits are sold in one-time packs of 10, 30 or 50 credits, enough for 1, 3 or 5 standard videos. There are no subscriptions and nothing renews automatically. A video with the lead singer, with or without the sax player, uses 10 credits; the full band uses 20 credits.
• No expiry — Credits do not expire.
• Failed videos — If a video fails, or your photo is rejected by the safety check, the credits for it are returned to your balance automatically.
• Refunds — Refunds are handled under our Refund Policy.
• Price changes — We may change prices. Credits you have already bought are not affected.

5. Your Photo and the Video

• Your permission — You may only upload a photo of yourself, or of an adult who has given you permission to use their likeness in an AI video. This applies to every photo you upload, and you confirm it each time you generate a video.
• Not allowed — Do not upload photos of minors, or of anyone who has not agreed. This includes celebrities and public figures: upload their photo only if you have their own authorization to use their likeness in an AI video. We may ask you to show that authorization, and we may remove content or restrict an account if it cannot be shown.
• What we do with it — We use your photos only to make your video. Photos are deleted within 7 days, and videos are kept for 7 days. Download what you want to keep.
• Use of the video — You may use the finished video for personal, non-commercial purposes, such as sharing it with friends and posting it on social media. Label it as AI-generated when you post it. You may not use it to mislead people, to harass anyone, or in advertising, because it is based on a performance and a trademark that belong to others.
• Our rights — The website, its design and our software belong to us.

6. Prohibited Content and Conduct

You may not upload, generate or share content that falls into any of these categories:

1. Pornography / NSFW — Nudity, sexually explicit or sexually suggestive material, or non-consensual intimate imagery.
2. Violence / Gore — Extreme gore, cruelty, content promoting suicide or self-harm, terrorism or violent extremism.
3. Hate — Hateful, threatening or harassing content aimed at a person or group because of race, ethnicity, religion, gender, sexual orientation, age or disability.
4. Child sexual abuse material — Zero tolerance. Any sexual content involving minors, or content that endangers minors, is forbidden. We will terminate the account and report it to law enforcement and the National Center for Missing & Exploited Children (NCMEC).
5. Impersonation and deception — Using someone's likeness without their consent, impersonating a person or organization, fraud, or spreading disinformation.
6. Infringement — Content that infringes copyright, trademarks or other rights.

You also may not scrape, attack, reverse engineer or overload the service, or try to bypass its safety checks and rate limits.

7. Safety Checks

Photos you upload are checked by an automated image-safety filter before a video is made. If any photo is flagged, we do not generate the video, we delete the photos you uploaded for it, and the credits are returned. Automated checks are not perfect, and we may also review reports and take action on content or accounts that break these Terms.

8. Reports and Enforcement

• Reporting — To report content or conduct that breaks these Terms or infringes your rights, email support@tinydesk.run (or use the Contact support button on the website if you are signed in) and describe the issue. Include the video or task ID if you have it.
• Enforcement — If we confirm a violation, we may delete the content, restrict or suspend the account, or terminate it and forfeit unused credits without refund. In cases involving child sexual abuse material or other serious illegality, we will report to the appropriate authorities.
• Appeals — If you think an action was a mistake, email support@tinydesk.run with an explanation and we will review it.

9. Disclaimer of Warranties

The service and all generated videos are provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of or inability to use the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Termination

We may suspend or terminate your access if we reasonably believe you have broken these Terms or acted without authorization. You can stop using the service at any time and ask us to delete your account.

12. Changes to These Terms

We may update these Terms. We will change the "Last Updated" date at the top when we do. Continued use of the service after an update means you agree to the updated Terms.
